Berkeley is working at Zimmer Rocky Mountain again until he has to go back to Texas for Security Forces training. We have not heard when he will be going back, but it could be as soon as October or as late as January. Right now we are just enjoying the time we have together and not even thinking about tech school yet. I am doing really well. Adjusting to life as a mother has been quite a challenge for me, but I finally am feeling like I am in somewhat of a comfortable routine with Asa. He is doing so much better in so many ways and life is a lot more fun for the both of us. The patent application on crystalline form Beta of Imatinib Mesylate was opposed in India. The marketed Imatinib Mesylate tablets (Gleevac) contains crystalline form Beta.

Earlier, innovator Novartis filed patent application in 1999 on crystalline form Beta of Imatinib Mesylate, subsequently; Chennai patent office rejected the patent application under section 3(d) of Indian patent act. Novartis appealed against this decision to IPAB. Also, Novartis unsuccessfully challenged Indian patent section 3(d).

As per section 3(d) of Indian patent act, incremental inventions of known substances like the pharmaceutical acceptable salts, esters, polymorphs, metabolites, particle size, complexes, co-crystals, combinations are unpatentable unless they differ significantly in terms of therapeutic efficacy.
